Throughout these terms and conditions, the terms “we”, “us” and “our” refers to Peter Baeksgaard Kirstensen, sole proprietor of this website branded as “The Wine Cellar Malta” and holder of VAT number MT 2716 7812 and registered address at 48, Triq Salvu Buhagiar, Marsaskala, MSK 0001 Malta, Europe. Throughout these terms and conditions, the term “this site”, refers to this website. By using this site via Mobile Application (Mobile App) or via a Web Browser (Internet Browser) you agree to these terms. If you do not agree to these terms, please refrain from using this online shop.

General Terms

We deliver to Malta. You must be of at least 17 (seventeen) years of age to make purchases from this website.

Accuracy of Information

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the products (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service or Products offered through this website.

Price and Product Modifications

Order Cancellations

Our cancellation policy applies if a cardholder makes a purchase payable by credit card or debit card and requests order cancellation prior to delivery. If the product is already in transit for delivery or has already been dispatched then order cancellation will not be possible. Given that your order has not yet been dispatched and that it has not been longer than 24 hours since you placed your order we will cancel your order and refund you by means of store credit applicable through the use of a coupon code generated specifically for you. We only accept cancellation requests via email, if applicable the coupon code will be sent to by return reply.

Returns and Refunds

We accept returns of unwanted products within two (2) weeks from consignment but reserve the right to refuse or charge a re-stocking fee should the full packaging be missing, damaged, non resealable or if the returned item/items show signs of use or if no valid reason is given for returning the item. If you wish to return a product, make sure to email us first to inform us with both the reason why your purchase is being returned and your order number. We will be unable to process your return without this information. Returns are evaluated on a case by case basis and it is up to our sole discretion to determine if your case is subject to refund or replacement.

Delivery Time

Our delivery time for Malta is 4 business days. If you are placing an order from Gozo and wish to have an estimated delivery time before placing your order please contact us first.

Governing Law

These Terms of Service and any separate agreements we provide you shall be governed by and construed in accordance with the laws of Malta, Europe.

Changes to these Terms

We reserve the right to modify or amend these terms at any time by posting the amended terms here. All amended terms take effect upon posting. Each time you use this site, the current version of our Terms and Conditions will govern your use. Accordingly, when you use this site, you should review the latest version.
